1. Who are we and what do we do?

L1NDA provides a Software-as-a-Service (SaaS) solution that enables Customers of L1NDA to schedule employees and perform workforce management (the Software). SaaS means that L1NDA offers the Software through an online environment in which Customers work. In addition, L1NDA provides training, hosting, maintenance services, and other support services (the Support Services). The Software and Supporting Services are collectively referred to as our Services.

2. Personal Data and Privacy Statement

We process Personal Data. Personal data is understood to mean: all information that can be used to directly or indirectly identify a person.

In this Privacy Statement, we explain what types of Personal Data we collect when providing our Services and Website. We also explain what role we have in the processing of your Personal Data, how long we store your Personal Data, and what rights you have as a data subject.

3. Our role as Data Processor and Controller

We process most Personal Data in the role of Data Processor within the meaning of the General Data Protection Regulation (GDPR). This includes, for example, the Personal Data of the employees of our Customers. We process this Personal Data solely on behalf of our Customers for the purpose of their workforce planning and not for our own purposes. We establish agreements regarding this processing in a data processing agreement that we enter into with all our Customers.

However, there are certain Personal Data that we process for our own purposes. In such cases, we act as Controller within the meaning of the GDPR. In this Privacy Statement, you will find information about the Personal Data for which we act as the Controller.

4. Which Personal Data do we process as Controller?

As a Controller, we may process your Personal Data in various situations. For example, when we provide our Services or when you contact us.

When we provide our Services to a Customer, we process the following Personal Data:

(Personal) Data:

  • First and last name of the Customer’s contact person;
  • Contact details (such as e-mail address and telephone number) of the Customer’s contact person; and
  • Data included in our agreement with the Customer.

Purpose(s):

We use this data to:

  • to conclude the agreement with the Customer;
  • to perform the obligations under the agreement and provide the Services;
  • to communicate with the Customer’s contact person regarding the performance of our Services; and
  • to include in our customer administration.

Legal basis:

We process this Personal Data because we have a legitimate interest in entering into and performing the agreement with the Customer.

Account information
Login details for the L1NDA account: domain name (XYZ.l1nda.nl), username, and password.

We use this data to:

grant you as a Customer access to your L1NDA account and the L1NDA environment.

We process this Personal Data because this is necessary for the performance of the agreement with the Customer.

Insofar as an employee/contact person logs in with their own data, we have a legitimate interest in performing the agreement with the Customer and thereby providing authorized persons with access to the L1NDA environment.

Financial information:

IBAN number, VAT number, and other relevant billing information.

We use this data to:

  • process payments;
  • keep track of our records of paid and outstanding fees; and
  • include in our (financial) administration.

We process this Personal Data to perform our agreement, or because we have a legitimate interest in keeping our own financial records.

Additionally, we are legally required to include (some of) this information in our administration and, where necessary, to share it with the Tax and Customs Administration (Belastingdienst).

Information about the type of device you use, the type of browser, session data (date, time), and your IP address.

We use this data to:

  • adapt our Website to the device you use;
  • ensure that you can use our Website properly; and
  • improve the user-friendliness of our Website.

We process this (Personal) Data because we have a legitimate interest in offering you a properly functioning Website and maintaining it.

Newsletters

First and last name and e-mail address.

We use this information to send newsletters about our (future) Services.

We process this Personal Data because we have a legitimate interest in informing you, as a Customer, about our (future) Services.

If you are not (yet) a Customer with us, we will only send newsletters if you have given permission for this.

Each newsletter contains a link with which you can easily unsubscribe.

Through our social media pages:

Data from visitors who leave a comment or post something on our social media pages, including the Personal Data in those comments and/or posts.

We use this data to:

  • contact visitors in response to their posts and/or comments via our social media pages;
  • support visitors in using our Services; and
  • improve our Services based on questions and feedback received.

We process this Personal Data because we have a legitimate interest to do so, namely to contact you, to assist you based on your comment or question, and to improve our Services in response to questions and feedback we receive.

5. Mandatory or necessary information
When you use our Services, it may be legally or contractually required to provide us with certain Personal Data, such as your contact information and financial information. Failure to provide such information usually means that we cannot provide you with certain Services or perform (part of) our agreement with you.

6. How long do we retain your Personal Data?

We retain Personal Data for as long as necessary for the purposes mentioned above, unless we are legally required to retain the Personal Data for a longer period. In any case, we adhere to the following retention periods:

  • Customer and contact details | This data is retained for as long as you are a Customer with us and for one (1) year thereafter, unless a longer (legal) retention period applies to certain data (as stated in this Privacy Statement).
  • Account details | The account data is retained for as long as you are a Customer with us and will be deleted after two (2) years after deactivating your account (unless stated otherwise).
  • Personal data in our (financial) administration | This data is retained for seven (7) years, unless we are legally obliged to keep the data longer.
  • Personal data in our correspondence | This data is retained for as long as necessary to handle your message/question/complaint.

After the expiration of the aforementioned retention periods, we may process and retain certain Personal Data to comply with legal retention obligations and/or for fraud/abuse investigations or to substantiate a legal claim. In such cases, we will keep the Personal Data separately and use it solely for the aforementioned purposes.

7. Do we share your Personal Data with third parties?

Data Processors
We use third parties (Data Processors) to support us in providing our Services. In this context, these Data Processors process Personal Data on our behalf. For example, we use Data Processors for hosting our e-mail services (Google, Mailchimp, Hubspot), maintaining a customer database/CRM (Hubspot), and hosting our server (AWS).

These Data Processors are only permitted to process the Personal Data collected by us and provided to them in the context of our instructions to them and under no circumstances for any other purpose. We conclude a data processing agreement with all these Data Processors.

Controllers
In the following cases, we may also share your Personal Data with other Controllers:

  • Payment processor Where necessary, we use a payment provider (Rabobank) to handle payments./li>
  • Accountant: We engage an accountant (BWK Finance) to maintain our accounting records.
  • Tax and Customs Administration (Belastingdienst): If we are required to include (part of) your Personal Data in our financial administration for the Tax and Customs Administration, we will share this information with the Tax and Customs Administration. The Tax and Customs Administration will process this Personal Data in accordance with its own privacy policy.

The above-mentioned parties only receive the Personal Data necessary to perform their tasks. Apart from the above, we will not share your Personal Data with third parties unless required by law.

8. Export of Personal Data outside the European Union

We may transfer Personal Data to parties outside the European Union if any of the aforementioned Data Processors or Controllers (or their (Sub-)Processors) is located outside the European Union. The Personal Data will only be transferred to countries and/or parties that offer an adequate level of protection in accordance with European standards. You can contact us if you would like more information or a copy of the safeguards we have in place for such transfers (where necessary).

9. Cookies

We use cookies on the Website. A cookie is a small text file that is stored on your device when you visit our Website. For example, this text file recognizes you as a returning visitor when you revisit our Website.
